PERSONALISED WEDDING TERMS OF SERVICE

Personalised Weddings (that is not booked as a Registry ceremony): A 20% minimum deposit or full payment guarantees your date is booked in and will be agreed upon our consultation. You are welcome to pay this off over time. From time to time, a double booking enquiry may occur and if no deposit has been paid, the next enquiry takes priority. If your ceremony is within 14 days of invoice date, a full payment is required. Please inform me if your ceremony start time, date or location changes, as I may have another commitment prior or after your ceremony.  

Refund Policy:  In the event of your ceremony being cancelled more than 14 days prior to the ceremony and cannot be rebooked with me but choose to use my personalised ceremony material already prepared for you, 25% of the fee will be refunded. If you are simply rebooking or I am not available due to unforeseen circumstances, but you choose to use the material I have prepared for you, I will ensure you have one of my fellow colleague celebrants take over (if you have already paid me in full, no extra handover charges will occur).

No extra fees for rebooking due to other uncontrollable circumstances such as a Pandemic.

FUNERAL TERMS OF SERVICE

Please take time to read my Terms and Conditions of trade. This, with our Code of Practice, as a member of CANZ (Celebrant Association of New Zealand) is there to protect everyone concerned.

Definitions
1.1 Celebrant: shall mean YourNZCelebrant and its successors and who it assigns.
1.2 Client: means any person engaging with YourNZCelebrant on the terms in this Contract and includes, unless the context otherwise indicates. This could also be the Will Executor or an approved Family member.
1.3 Contract: means the agreed to terms and conditions between the Client and YourNZCelebrant as set out in the following document.
1.4 Guarantor: means that person (or persons), or entity who agrees herein to be liable for the debts of the Client if a Limited Liability Client on a principal debtor basis.
1.5 Services: shall mean all services supplied by YourNZCelebrant to the Client and includes any advice or recommendations (and where the context so permits shall include any supply of Services).
1.6 Price: shall mean the cost of the Goods as agreed between YourNZCelebrant and the Client subject to clause 4 of this agreement.
1.7 Destination: means the place to which the Client has requested YourNZCelebrant to carry out the service to include (for the avoidance of doubt) any church, chapel, home, garage, crematorium, hospital, burial ground or other place where the Deceased is to be handed over or buried.

Acceptance
2.1 Any instructions received by YourNZCelebrant from the Client (or on behalf of the Funeral Director) for the supply of Services and/or Goods supplied by YourNZCelebrant shall constitute acceptance of the terms and conditions contained herein.
2.2 Where more than one Client, Will Executor or Family member has entered into this agreement, the Clients shall be jointly and severally liable for all payments of the Price.
2.3 Upon acceptance of these terms and conditions by the Client, Will Executor or Family member, the terms and conditions are irrevocable.

Price and Payment
3.1 At the Celebrant’s sole discretion (or as agreed by your Funeral Director):
(a) the Price shall be at the Celebrant’s current price; or
(b) the Price shall be as indicated on invoices provided by YourNZCelebrant to the Client in respect of Services supplied

3.2  YourNZCelebrant may, by giving notice to the Client at any time, increase the Price of the Goods/Services to reflect any increase in the cost to YourNZCelebrant beyond the reasonable control of YourNZCelebrant.
3.3 At the Celebrant’s sole discretion a deposit may be required. The deposit amount or percentage of the Price will be stipulated at the time of the order of the Goods/Services and shall become immediately due and payable.
3.4 Time for payment for the Goods/Services shall be of the essence and will be stated on the agreement or any other forms. If no time is stated, then at least part payment shall be due on or before the date of the funeral service and before the cremation/burial takes place.
3.5  YourNZCelebrant may withhold delivery of any Goods (ie Order of Service brochure design and print, PPT slideshow) until the Client has paid for them, in which event payment shall be made before the service.
3.6 At the Celebrant’s sole discretion payment may be due at the date of this agreement. General Terms of Payment are within 7 days of the service being held.
3.7 At the Celebrant’s sole discretion, payment for approved Clients shall be made by instalments in accordance with the Celebrant’s payment schedule.
3.8 Payment can be made by cash, Online bank payment, Stripe (accepting Debit or Credit Card incurring a small transaction fee) or by any other method as agreed to between the Client and the YourNZCelebrant.

Third Party Expenses
4.1 Because of the nature of the Goods/Services supplied, YourNZCelebrant may incur third party costs. For example: print costs for the Order of Service brochure. Payment of such costs will be due as set out in clause 3 of this contract.

Delivery Of Goods / Services
5.1 YourNZCelebrant shall not be liable for any loss or damage whatsoever due to failure by YourNZCelebrant to meet the agreed funeral service where this is due to circumstances beyond the control of the Celebrant.
5.2  YourNZCelebrant shall not be liable for any loss, damage or injury caused by or to any product item or thing supplied by the client for use during the funeral.

Limitation of Liability
6.1 YourNZCelebrant shall only be liable to the Client where it causes by its negligence or wilful misconduct.
6.2  YourNZCelebrant shall not be liable to the Client for any reason if the breach of Contract was due to any cause beyond the Celebrant’s reasonable control. The following events shall be regarded as examples of causes beyond the Celebrant’s reasonable control but shall not act to limit the general nature of this clause: Act of God, explosion, flood, tempest, fire, accident, civil disturbance, Acts, restrictions, regulations, bye-laws, pandemic, prohibitions or measure of any kind on the part of any governmental, parliamentary or local authority, difficulties in obtaining labour, fuel, motor vehicle breakdown for whatever reason.
6.3  YourNZCelebrant shall in no circumstances be liable to the Client for any loss, claim or liability of whatever nature caused by the acts or omissions, finding errors after approval of Service written; not completing the Service written by the Celebrant when asked for approval of the Client or any third party contact involved.
6.4 Subject as expressly provided in this Contract and except where the supply of the service is to a person dealing as a consumer (within the meaning of the Independent Contractors Act 1977), all warranties, conditions, representations or other terms implied by statute or common law are excluded to the fullest extent permitted by law.you have a creative project to share with the world.
